The Site is normally accessible to users at all times. However, Merith Technologies may decide to interrupt access for technical maintenance and will endeavour to inform users in advance of the dates and times of any such intervention.
4. Description of the services provided
The purpose of the Site is to provide information about the activities of Merith Technologies. Merith Technologies endeavours to provide information on the Site that is as accurate as possible. However, it cannot be held liable for omissions, inaccuracies or failures to update such information, whether attributable to itself or to third-party partners who supply it.
All information on the Site is provided for guidance only, is non-exhaustive and is subject to change. It is given subject to modifications that may have been made since it was published online.
5. Technical limitations
The Site uses JavaScript technology. The user undertakes to access the Site using recent, virus-free equipment and an up-to-date, latest-generation browser. Merith Technologies cannot be held liable for material damage connected with the use of the Site.
The hosting provider ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service, for the shortest possible periods, in particular for maintenance, infrastructure improvements, infrastructure failure, or if the services generate traffic deemed abnormal. Merith Technologies and the hosting provider cannot be held liable in the event of malfunction of the Internet network, telephone lines, or computer and telephony equipment, in particular due to network congestion preventing access to the server.
6. Intellectual property and counterfeiting
The Site constitutes a work protected by the provisions of the French Intellectual Property Code and applicable international regulations. Merith Technologies owns the intellectual property rights or holds the rights of use over all elements accessible on the Site, including but not limited to texts, images, graphics, logos, videos, icons and sounds (subject to the exception below).
Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the Site, by any means or process whatsoever, is prohibited without the prior written authorisation of Merith Technologies. Any unauthorised use of the Site or of any of the elements it contains will be deemed to constitute counterfeiting and will be prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.
The logos of Merith Technologies’ clients and the projects carried out for those clients remain the property of their respective owners and are used for illustration purposes only.
7. Limitation of liability
Merith Technologies acts as the publisher of the Site and is responsible for the quality and accuracy of the content it publishes.
Merith Technologies cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing the Site, resulting either from the use of equipment that does not meet the specifications set out in section 5, or from the appearance of a bug or an incompatibility. Merith Technologies also cannot be held liable for indirect damage (such as loss of business or loss of opportunity) resulting from the use of the Site.
Interactive areas (such as the contact form) are available to users. Merith Technologies reserves the right to delete, without prior notice, any content posted in these areas that contravenes the legislation applicable in France, in particular data protection provisions. Where applicable, Merith Technologies also reserves the right to pursue the civil and/or criminal liability of the user, in particular in the event of racist, abusive, defamatory or pornographic messages, whatever the medium used (text, photograph, etc.).

The Site contains hyperlinks to third-party websites. Merith Technologies has no control over the content of those sites and accepts no liability in respect of them.
9. Personal data and cookies
The conditions under which Merith Technologies processes personal data and uses cookies are described in our Privacy Policy, which forms an integral part of this legal notice. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 as amended (Loi Informatique et Libertés).
10. Governing law and jurisdiction
Any dispute relating to the use of the Site is governed by French law. Except where a mandatory rule of law provides otherwise, exclusive jurisdiction is granted to the competent courts of Paris.
